THE GENERAL TERMS OF SALE

Preliminary Article

La Maison Duret is a company that sells leather goods. It also creates made-to-measure leather goods and operates in the luxury sector.

Maison Duret has created objects of design, leather goods and accessories for over 20 years.

The creation and management of the company’s commercial website have been entrusted to a third-party company:

The general terms of sale (hereinafter referred to as the General Terms of Sale), which apply to sales of products available on the website https://www.duret-paris.com (hereinafter the Website), are hereby deemed to have legal force:

Any other natural person of legal age who is not a merchant (hereinafter the Customer) with the legal capacity to enter into contracts, who is an exclusive resident of one of the countries to which the Website ships.

The resale of products is strictly prohibited to all buyers trading in a professional capacity.

Placing an order via the Website implies acceptance, without restrictions or reservations, of these General Terms of Sale, which are accessible at all times on the Website, including at the time of order placement.

These General Terms of Sale may be modified at any time, and any new General Terms of Sale shall become immediately applicable to any orders placed subsequent to their publication on the Website. If, at that time, an older version of the General Terms of Sale remains accessible to the public on another website or by any other means, that version may no longer be invoked against Duret Paris.

The distance selling system put in place on the Website is in strict compliance with the requirements pertaining to distance selling, including those set forth in articles L.111-1, L.112-1 and L.221-1 et seq. of the French Consumer Code.

Article 1 – SCOPE

These General Terms of Sale serve to define the framework for all contractual relationships arising from sales made via the Website for shipment worldwide.

This contractual framework covers all of the phases of the sale: from order placement to delivery, as well as any refunds or exchanges.

Article 2 – PRODUCTS

The products for sale on this Website are those available on the Website or in the store on the order date.

Each product has a product sheet that describes all of its essential characteristics, including its price, pictures, dimensions, composition and available colourways.

The customer must be informed that there may be subtle differences between a product and its photograph, in particular for image quality reasons.

The products sold on the Website comply with the human safety and health requirements set forth by French and European legislation, and in particular the laws pertaining to controlled chemicals.

The products sold on the Website also comply with the requirements of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES), intended to ensure that the international trade of wild plant and animal specimens does not endanger the survival of the species they belong to. Compliance with this convention and the related formalities result in longer order processing and dispatch times.

Article 3 – PRICING OF ITEMS SOLD

Prices are stated in euros, inclusive of tax, based on the VAT applicable in France on the order date.

Duret Paris reserves the right to change its prices at any time, it being understood that the pricing applicable to the customer is that displayed on the Website on the order date and subsequently confirmed during order validation.

Shipping fees, which are charged to the customer, are indicated in the order summary before validation. They are stated inclusive of tax and are added to the sale price of the products.

In accordance with the provisions of article L. 221-11 of the Consumer Code, written confirmation is sent to the customer for each shipment, specifying the price paid and the shipping fees charged.

If an excessively low or incorrect price is displayed, for whatever reason (human or computer error), the Customer shall be informed as soon as possible that his order has been cancelled, even if it has already been validated by Duret Paris.

Orders placed on the Website go through multiple steps, in accordance with the provisions of article 1125 et seq. of the French Civil Code.

Article 4 – ORDER PLACEMENT

Orders placed on the Website are broken down into several steps, in accordance with the provisions of articles 1125 et seq. of the French Civil Code:

Step 1: The customer selects the desired product(s) and adds them to his cart, which indicates how many items have been selected.

Step 2: The customer verifies that his cart contains the items selected and, by clicking on “place order”, accesses a summary of his order that can still be modified.

Step 3: After verifying his order and modifying it if necessary, the customer confirms his cart by once again clicking “place order” to finalize his order.

Step 4: The customer must enter his delivery and billing information; by default, the latter is the same as the delivery address. If he already has a customer account, he must log in by entering his email address and password; otherwise, he must create an account.

The customer verifies the information entered and clicks on “confirm or make payment” to continue the order process.

Confirming the order implies automatic acceptance of the General Terms of Sale.

Step 5: The customer must indicate the payment method used and then enter his account information (type of card, cardholder’s name, number, expiration date, security code) once the secure payment screen appears.

When the payment is accepted, the customer is automatically redirected to an order confirmation screen on the Website.

Purchases made via the Website are therefore secure, using encryption to ensure the confidentiality of the bank details submitted. No card numbers are kept by the Website.

Pursuant to article L.121-11 of the French Consumer Code, Duret Paris reserves the right to refuse any unusual transactions, or transactions with customers involved in a dispute concerning the payment of a previous order.

Step 6: Once the payment has been accepted, the Customer receives an electronic confirmation of his order, with a summary of its contents, the order amount, and the billing and delivery address(es).

The sale shall only be considered final once this confirmation has been issued.

Once the order has been shipped, the customer will receive an electronic order shipment notification.

Article 5 – MODES OF PAYMENT

Payment is made at the time of order placement, by bank card (debit card, Visa, Eurocard/Mastercard, American Express) or via a PayPal account.

The amount is charged to the Customer’s card at the time of order placement.

Payments made via the Internet are directly verified with the banking establishment, which is contacted via the secure online transaction system known as the SSL (Secure Socket Layer) protocol using the 3D Secure system.

Purchases made on the Website are therefore secure, as encryption is used to protect the confidentiality of the bank details submitted. No credit card numbers are kept by the Website.

Under certain conditions, Duret Paris reserves the right to request additional documents such as a photocopy of the customer’s identity card or proof of address in order to confirm the order and ship the package.

Article 6 – SHIPPING

Orders are generally shipped 4 weeks after receipt of payment.

The items sold are shipped with a delivery note. Delivery time may vary depending on the shipping service selected by the Customer.

Home delivery: Products are shipped via Fedex for delivery outside France with a tracking number and drop-off without a signature, in which case the delivery time is between 2 and 5 days.

They can be sent via Chronopost, with signature required upon delivery, in which case the delivery time is 24 hours. If the Customer wishes to select this shipping option, he must contact Duret Paris directly, as the shipping fees will be higher.

They can also be sent via Colissimo, with signature required upon delivery, in which case the delivery time is 48 hours.

Regardless of the home delivery method selected, Duret Paris will send you a link to track your order online.

Home delivery by courier is also possible within the Paris city limits.

Upon receipt of the package, the Customer is expected to check that its contents correspond to the order placed. Any issues concerning the packaging or products must be notified within the legal time limits following receipt of the order.

Article 7 – RIGHT OF RETRACTION – PRODUCT RETURNS – REFUNDS OR EXCHANGES

Any Customer who is not satisfied with his order may exercise the right of retraction provided for in article L. 221-18 of the French Consumer Code within fourteen days following receipt of the item, with no need to give a reason for his decision.

Notification of exercise of this right may be sent by email to the following address: contact@duret-paris.com.

In the event of a retraction, the Customer must return the item(s) no later than fourteen days after notifying Duret Paris of his decision to retract his order.

Returns made within France must be brought to the store; for international customers, they may be sent by mail.

Items must be returned in their original condition. Returns of incomplete, damaged or dirty items will not be accepted.

The Customer shall bear the costs and risks associated with the return process.

Under the conditions indicated above, Duret Paris will refund to the Customer the full price of the returned item, including tax, as soon as possible. The refund will be issued to the means of payment used for the initial transaction.

The Customer also has the option to exchange the items delivered.

Article 8 – CONDITIONS APPLICABLE TO CUSTOMIZED ITEMS

Duret Paris also offers a customization service for certain products.

For custom orders or made-to-measure belts, the aforementioned right of retraction may not be exercised, in accordance with the provisions of article L. 221-28 of the French Consumer Code.

For special requests or custom upholstery, the customer may not exchange or return the items delivered, nor receive a refund.

The processing time for these items is 5 weeks, longer than for items made without customization.

Article 9 – AFTER-SALES SERVICE

The after-sales service is responsible for the repair of items damaged by normal wear, as well as for repairs covered by a legal warranty.

Article 10 – LEGAL WARRANTIES – LIABILITY – FORCE MAJEURE

The items sold on the Website comply with the regulations in force and are subject to the warranty requirements provided for by law.

There are two such legal warranties: firstly, the legal guarantee of conformity provided for in articles L.217-4 et seq. of the French Consumer Code, and secondly, the legal guarantee against hidden defects set forth in articles 1641 et seq. of the French Civil Code.

Duret Paris shall not be held liable for any failure to execute all or part of its obligations that results from a force majeure event, as defined by substantive law. In such an event, Duret Paris must inform the customer of the difficulties encountered. If these difficulties persist for more than 30 days, the customer may obtain a refund on his order under the conditions set forth in article 7 herein.

Duret Paris accepts no liability with regard to differences in colour between the product photograph as seen on-screen and the product’s true colour, as colours may appear different on-screen and in real life.

Duret Paris shall not be held liable for any failure to execute all or part of its obligations that results from a force majeure event, as defined by substantive law. In such an event, Duret Paris must inform the customer of the difficulties encountered. If these difficulties persist for more than 30 days, the customer may obtain a refund on his order under the conditions set forth in article 7 herein.

Article 11 – SECURITY, INFORMATION TECHNOLOGY AND FREEDOMS

Duret Paris undertakes to take all necessary precautions to protect the confidentiality of the information provided by Customers.

If an amicable solution cannot be reached, any dispute arising between the parties shall be submitted to the exclusive jurisdiction of the High Court of Paris.

The database created meets the requirements of Regulation no. 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing and free movement of their personal data.

The Customer has the right to access, rectify or object to the use of the information provided.

Depending on the options selected by the Customer, the latter may agree to receive commercial proposals and may unsubscribe from the Newsletter at any time.

Article 12 – INTELLECTUAL PROPERTY

If any article of these General Terms of Sale is found to be void, illegal or unenforceable by a judicial decision, their other provisions shall remain applicable.

These General Terms of Sale are governed by French law.
